Capitalised terms used in these terms and conditions have specific meanings defined under certain conditions. The definitions provided shall have the same meaning whether used in the singular or plural form.
For the purposes of these Terms and Conditions:
Affiliate refers to an entity that controls, is controlled by, or is under common control with a party. "Control" in this context means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.
Account means a unique account created for you to access the Service or parts of the Service.
Country refers to the United Kingdom.
Company (referred to as "the Company," "FILMD," "We," "Us," or "Our") refers to FILMD Services Ltd, authorised to operate the FILMD platform under licence from FILMD Ltd, with registered office at 5 Ribblesdale Place, Preston, England, PR1 8BZ. References to FILMD may include FILMD Ltd where appropriate, including in relation to ownership of intellectual property.
User Content (or Content) refers to any content, information or materials submitted, uploaded, posted, shared or otherwise made available by users through the Service, including text, images, video, audio, documents, messages, profiles, recommendations, productions, submissions, scripts and other materials, regardless of format.
Device means any device capable of accessing the Service, such as a computer, mobile phone or tablet.
Feedback means any feedback, suggestions, ideas or other input provided by you regarding the Service, including its attributes, performance or features.
Free Trial refers to a limited period of time that may be offered at no charge when purchasing a Subscription, where applicable.
Promotions refer to contests, sweepstakes, grants or other promotional initiatives offered through the Service.
Service refers to the FILMD platform, including our websites, web applications, mobile applications (iOS and Android), software, features, functionality, content and services provided by FILMD from time to time.
Subscriptions refer to paid access to certain features or services offered on a subscription basis through the Service.
Terms and Conditions (also referred to as "Terms") mean these Terms and Conditions, together with any policies or guidelines referenced herein, that constitute the entire agreement between you and the Company regarding your use of the Service.
Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third party that may be displayed, included or made available through the Service.
Website refers to FILMD, accessible from https://www.filmd.co.uk and https://app.filmd.co.uk.
You means the individual accessing or using the Service, or the company or other legal entity on whose behalf such individual is accessing or using the Service, as applicable.
These Terms govern your access to and use of the Service and constitute a legally binding agreement between you and the Company. They set out the rights and obligations of users in relation to the Service.
Your access to and use of the Service is conditional upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not access or use the Service.
You represent and warrant that you are at least 18 years of age. The Service is not intended for, and may not be used by, individuals under the age of 18.
Your access to and use of the Service is also subject to the Company’s Privacy Policy, which describes how we collect, use and protect personal information and explains your privacy rights. You should review the Privacy Policy carefully before using the Service.
Certain parts of our Service are only available through a paid Subscription. You will be billed in advance on a recurring and periodic basis (such as daily, weekly, monthly, or annually), depending on the Subscription plan you select.
Subscription Cancellations:You have the option to cancel the automatic renewal of your Subscription either through your Account settings page or by contacting the Company, unless your Subscription was purchased via the Apple App Store, in which case you must manage or cancel it via your Apple ID subscription settings. Please note that no refunds will be provided for fees already paid for the current Subscription period, except when required by law or where a purchase is subject to the Apple App Store refund process.
Billing:This billing process applies to Subscriptions purchased via the FILMD website. You are responsible for providing accurate and complete billing information. If you purchase a Subscription via the Apple App Store, billing is handled by Apple and we do not collect or store your payment details for that transaction. In the event of automatic billing failure for website purchases, the Company will issue an electronic invoice and you will be required to manually make the full payment within a specified deadline, as indicated on the invoice.
Fee Changes:The Company reserves the right to modify the Subscription fees at any time, at its sole discretion. Any changes in Subscription fees will become effective at the end of the current Subscription period. We will provide reasonable prior notice of such fee changes, allowing you an opportunity to terminate your Subscription before the modified fees take effect.
Refunds:Except when required by law, paid Subscription fees are non-refundable. For Subscriptions purchased via the FILMD website, the Company may consider certain refund requests on a case-by-case basis, solely at its discretion. For Subscriptions purchased via the Apple App Store, refunds are handled by Apple and must be requested directly from Apple.
FILMD Membership may be purchased either via our website or through in-app purchase within the FILMD iOS application.
If you purchase FILMD Membership through the iOS app, payment will be processed by Apple using your Apple ID. Apple manages billing, renewals, cancellations and refunds for all subscriptions purchased through the App Store. FILMD does not have access to your payment details and cannot modify, cancel, or refund subscriptions purchased via Apple.
Subscriptions purchased through the Apple App Store automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current subscription period. You can manage or cancel your App Store subscription at any time via your Apple ID subscription settings.
Subscriptions are tied to the platform on which they are purchased. Subscriptions purchased via the FILMD website are governed by our website billing terms and refund policy. Subscriptions purchased via the Apple App Store are governed by Apple’s subscription and refund policies, and any refund requests for App Store purchases must be made directly to Apple.
Any Promotions made available through the Service may be subject to separate rules, distinct from these Terms. If you participate in any Promotions, we advise you to review the applicable rules along with our Privacy Policy. In the event of a conflict between the Promotion rules and these Terms, the rules specific to the Promotion will prevail.
When creating an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of these Terms, and we may terminate your account immediately.
Account Security:You are responsible for safeguarding the password used to access the Service. Any activities or actions carried out under your password, whether by you or a third party, are your responsibility. You agree not to disclose your password to any third party and must promptly notify us of any security breach or unauthorised use of your account.
Username Usage:You may not use a username that belongs to another person or entity without appropriate authorization. Additionally, usernames that are offensive, vulgar, obscene, or infringe upon the rights of others are prohibited.
FILMD may allow you to submit, upload, post, share or otherwise make available content in connection with the Service, including text, images, videos, documents (including PDFs), links and other materials ("User Content"). This includes (without limitation) content submitted through the Community Feed, profiles, messages, productions, job applications, grants, the Screening Room and any other submission or upload features made available on FILMD.
Responsibility for User Content:You are solely responsible for the User Content you submit or make available on FILMD and for ensuring that you have all necessary rights, permissions and authority to do so. You agree that your User Content will be accurate where it purports to be factual and will not be misleading. FILMD does not endorse, verify or guarantee the accuracy, integrity or quality of any User Content posted or submitted by users.
Prohibited Content and Conduct:You agree not to submit or make available any User Content that is unlawful, misleading, defamatory, abusive, threatening, harassing or hateful; infringes the intellectual property, privacy or other rights of any third party; contains pornographic, sexually explicit or exploitative material; promotes violence, discrimination, extremism or illegal activity; contains malware or malicious code; constitutes spam, unsolicited promotions or deceptive practices; or impersonates another person or misrepresents your affiliation with any individual or organisation.
Visibility and Sharing:User Content may be viewed by other users of the Service and, depending on your privacy and visibility settings and the feature used, may be publicly accessible. You acknowledge that content you choose to share may be seen, saved, shared or interacted with by others.
Moderation and Enforcement:FILMD is not obligated to monitor User Content but reserves the right, at its sole discretion, to review, moderate, restrict, remove or disable access to any User Content at any time, with or without notice, where we reasonably believe such content violates these Terms, applicable law, or poses a risk to users, productions or the platform. FILMD may also suspend or terminate accounts that repeatedly or seriously breach these Terms.
Reporting and Takedown Requests:If you believe User Content infringes your rights, is unlawful, or breaches these Terms, you may report it using the in-platform reporting tools (where available) or submit a takedown request using the contact details provided in these Terms. FILMD will assess reports and requests in good faith but does not guarantee removal in every case. The availability of reporting tools does not create an obligation on FILMD to monitor, review or take action on any particular content within a specific timeframe.
Licence to Use User Content:By submitting User Content to FILMD, you grant FILMD a non-exclusive, worldwide, royalty-free and sublicensable licence to use, host, store, reproduce, display, distribute, adapt and format such User Content solely for the purposes of operating, providing, promoting and improving the Service and related features. You retain ownership of your User Content.
Community Guidelines:Use of the Community Feed, direct messages, profiles, productions and any other user-generated content features must comply with our Community Guidelines. The Community Guidelines form part of these Terms and Conditions and may be updated from time to time. If there is any conflict between the Community Guidelines and these Terms and Conditions, these Terms and Conditions prevail.
Retention and Backups:FILMD does not guarantee the ongoing availability or preservation of User Content. While we may perform regular backups, we do not guarantee that there will be no loss or corruption of data, and we are not liable for any loss or damage resulting from the integrity of User Content or the inability to restore it. You are responsible for maintaining your own copies of any User Content you upload or submit.
The FILMD Screening Room allows users to submit, upload and make available films, video projects and other audiovisual works ("Screening Room Content") for viewing by other users of the Service. The Screening Room is intended to showcase creative work and facilitate discovery and feedback, and does not constitute a distribution, broadcasting or publishing service.
Responsibility for Screening Room Content:You are solely responsible for any Screening Room Content you submit, upload or make available through the Service. You represent and warrant that you own or have secured all necessary rights, licences, consents and permissions to submit and make the Screening Room Content available on FILMD, including (without limitation) copyright, neighbouring rights, performers’ rights, moral rights, music synchronisation rights, and any third- party rights appearing in the content.
Copyright and Intellectual Property:You agree that Screening Room Content must not infringe the intellectual property rights, privacy rights or other rights of any third party. FILMD does not independently verify ownership or licensing of submitted content and relies on the representations made by the submitting user. Any disputes relating to ownership, rights or permissions in Screening Room Content are solely between the submitting user and the relevant rights holder.
Indemnity:You agree to indemnify and hold harmless FILMD from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with your Screening Room Content, including any allegation that such content infringes the rights of any third party or breaches applicable law.
Licence to Display Screening Room Content:By submitting content to the Screening Room, you grant FILMD a non-exclusive, worldwide, royalty-free and sublicensable licence to host, store, stream, publicly display, reproduce and distribute the content solely for the purposes of operating, promoting and providing the Screening Room and the FILMD platform. You retain all ownership rights in your content.
This licence includes the right for FILMD to use short excerpts, stills or clips of Screening Room Content for promotional and publicity purposes in connection with the Screening Room and the FILMD platform, including on FILMD-owned marketing channels.
Advertising, Sponsorship and Promotional Content:You confirm that any paid promotional content contained within Screening Room Content is integral to the creative work (for example, in-story product placement or fictional brands) and does not constitute standalone advertising for third-party products or services. Direct advertising, endorsements or sponsorship promotions that are unrelated to the narrative or creative work are prohibited unless expressly approved in writing by FILMD.
Compliance with Law and Industry Standards:Screening Room Content must comply with all applicable laws, regulations and industry standards, including (where applicable) the UK Code of Non-broadcast Advertising (CAP Code), Advertising Standards Authority guidelines, and the Consumer Protection from Unfair Trading Regulations 2008. Where content includes sponsorship, paid promotion or financial backing, appropriate disclosure must be made in accordance with applicable law.
Moderation, Review and Removal:FILMD is not obligated to review Screening Room Content prior to publication but reserves the right, at its sole discretion, to review, moderate, restrict, remove or disable access to any content at any time, with or without notice. This includes where FILMD reasonably believes the content infringes rights, violates these Terms, breaches applicable law, or may expose FILMD, users or third parties to legal, reputational or operational risk.
Reporting and Takedown Requests:If you believe Screening Room Content infringes your rights or is otherwise unlawful, you may report it using the in-platform reporting tools (where available) or submit a takedown request using the contact details provided in these Terms. FILMD will assess reports in good faith but does not guarantee removal in every case and is not required to act within a specific timeframe.
No Endorsement or Classification:Screening Room Content is submitted by users. FILMD does not endorse, certify, classify or guarantee the quality, legality or suitability of any content made available in the Screening Room, and does not represent that such content is suitable for all audiences.
No Confidential Submissions:Do not submit Screening Room Content that is confidential or that you do not have the right to share. FILMD does not accept or treat Screening Room submissions as confidential, and you acknowledge that similar concepts or works may already exist or may be independently developed by others.
Availability and Removal of Content:FILMD does not guarantee the availability, prominence or duration of any Screening Room Content and may remove or restrict access to content at any time. You acknowledge that content may be unavailable due to moderation, takedown requests, technical issues or changes to the Service, and FILMD shall not be liable for any resulting loss or damage.
FILMD allows users to create and maintain professional profiles that may include personal information, biographies, work history, credits, equipment, skills, agent or representative details, media, links and other information ("Profile Content"). Profile Content is provided by users and is not verified by FILMD unless expressly stated otherwise.
Accuracy and Responsibility:You are solely responsible for the accuracy, completeness and currency of your Profile Content and for ensuring that you have the right to share any information, materials or representations included on your profile. FILMD does not endorse, guarantee or warrant the accuracy, legitimacy or professional standing of any user or Profile Content.
No Professional Verification or Guarantee:Profile Content, including listed experience, credits, equipment, availability, representation or affiliations, does not constitute a certification, accreditation or guarantee by FILMD. Unless expressly stated as part of a specific FILMD service, FILMD does not verify professional qualifications, employment history, ownership of equipment or suitability for any role.
Recommendations and Endorsements:FILMD may allow users to provide recommendations, testimonials or endorsements for other users ("Recommendations"). Recommendations reflect the personal opinions and experiences of the recommending user only and do not represent the views, endorsement or approval of FILMD. FILMD does not verify the accuracy or truthfulness of Recommendations.
Visibility and Control of Recommendations:Recommendations may be submitted privately and displayed publicly only where the recipient user chooses to make them visible on their profile. FILMD does not guarantee that Recommendations are accurate, balanced or complete, and users should exercise their own judgement when relying on such information.
Social Signals and Following:FILMD may allow users to follow or connect with other users and display social signals such as followers, following lists or activity indicators. These features are provided for informational and networking purposes only and do not imply endorsement, recommendation, affiliation or approval by FILMD or by any user.
Reliance on Profile Information:You agree not to rely solely on Profile Content, Recommendations or social signals when making decisions about hiring, collaboration, engagement or professional relationships. Any reliance on such information is at your own risk, and FILMD shall not be responsible for outcomes arising from reliance on user profiles or social features.
Moderation and Removal:FILMD reserves the right, but is not obligated, to review, moderate, restrict or remove Profile Content, Recommendations or social features at any time, with or without notice, where we reasonably believe such content violates these Terms, applicable law, or poses a risk to users or the platform.
Limitation of Liability:Your use of this feature is subject to the Disclaimers and Limitation of Liability section of these Terms.
FILMD may offer verification, badges or other trust indicators ("Verification") to help users assess identity and improve confidence when connecting and collaborating. Verification may be displayed on user profiles, in search results, on the Members Map, in messages or in other areas of the Service.
What Verification Means:Verification indicates only that FILMD (or a third-party service provider acting on our behalf) has completed a limited verification process based on the information provided at the time of verification. Verification does not constitute an endorsement, certification, accreditation, guarantee of identity in all circumstances, guarantee of professional competence, guarantee of work history, guarantee of good conduct, guarantee of safety, or guarantee of payment.
What Verification Does Not Cover:Unless expressly stated otherwise as part of a specific FILMD service, Verification does not include background checks, criminal record checks, right-to-work checks, credit checks, financial due diligence, reference checks, qualification checks, or validation of credits, equipment ownership, availability, affiliations, unions, agents or representatives.
Third-Party Providers:FILMD may use third-party providers to carry out all or part of the verification process. You acknowledge that verification outcomes may depend on third-party systems and information sources, and FILMD is not responsible for errors, omissions, delays or failures caused by third parties.
Changes, Expiry and Removal:Verification status may change, expire or be removed at any time, including where user information changes, where verification is suspected to be inaccurate, where misuse is reported, or where FILMD updates its verification criteria or processes. FILMD is not obligated to maintain Verification status for any user.
User Responsibility and Due Diligence:You remain responsible for exercising appropriate judgement and due diligence when hiring, working with or meeting other users, including users who display Verification. You agree not to rely solely on Verification when making decisions relating to engagements, payments, access to productions, or personal safety.
Misuse and Enforcement:Users must not misrepresent or misuse Verification, including by implying that Verification is a guarantee or an endorsement by FILMD. FILMD reserves the right to suspend, revoke or restrict Verification and take enforcement action where misuse is suspected.
Limitation of Liability:Your use of this feature is subject to the Disclaimers and Limitation of Liability section of these Terms.
FILMD may allow users to post, view, apply for, and communicate in relation to job opportunities, roles, calls for submissions, crew positions, castings or similar opportunities (collectively, "Jobs") through the Service. FILMD provides these features solely as a platform to facilitate discovery and communication between users.
No Guarantee of Work or Outcomes:FILMD does not guarantee that any Job will result in an offer of work, engagement, contract, payment, credit or any other outcome. Submitting an application, expressing interest, or communicating via the Service does not guarantee selection, response, engagement or hiring.
No Employment or Agency Relationship:FILMD is not an employer, recruiter, agent, casting agent, employment agency, payroll provider or representative of any user. FILMD does not enter into employment or contractual relationships on behalf of users and does not supervise, direct or control the work, conduct or performance of any individual or production.
Responsibility of Hirers:Users who post Jobs ("Hirers") are solely responsible for the accuracy, legality and legitimacy of their Job postings, for compliance with applicable employment, tax, health and safety and equality laws, and for any decisions made in connection with applications, selection, engagement, payment, credits and working conditions. FILMD does not verify the identity, status, funding or credibility of Hirers unless expressly stated otherwise.
Responsibility of Applicants:Users who apply for Jobs ("Applicants") are solely responsible for the accuracy and completeness of the information they provide, including qualifications, availability, experience and right to work. Applicants are responsible for conducting their own due diligence before accepting any role, engagement or offer of work.
Hiring Decisions and Disputes:All hiring decisions, negotiations, agreements and disputes arising from Jobs or applications are strictly between the Hirer and the Applicant. FILMD is not responsible for, and shall not be liable for, any disputes, claims, losses or damages arising from Job postings, applications, hiring decisions, failed engagements, misrepresentation, non-payment, delays, cancellations, or conduct occurring on or off the platform.
Payments and Contracts:FILMD does not guarantee payment for any Job unless expressly stated as part of a specific FILMD service or feature. Any contracts, agreements or payment arrangements entered into between users are made independently of FILMD and at the users’ own risk. FILMD is not responsible for enforcing contracts, collecting payments or resolving payment disputes between users.
Content and Communications:Communications, materials and representations exchanged in connection with Jobs or applications are user-generated content. FILMD does not verify, endorse or guarantee the accuracy or legitimacy of any Job posting, application, message or representation made by users.
No Screening or Vetting:FILMD does not conduct background checks, right-to-work checks, criminal record checks, credit checks, or screening of users or Job postings, and does not guarantee the identity, suitability, competence, qualifications or conduct of any user, unless expressly stated otherwise as part of a specific FILMD service.
Moderation and Removal:FILMD reserves the right, but is not obligated, to review, moderate, restrict or remove any Job posting, application or related content at any time, with or without notice, where we reasonably believe it violates these Terms, applicable law, or poses a risk to users, productions or the platform.
Safety and Due Diligence:You are responsible for exercising appropriate caution and judgement when interacting with other users, communicating, attending auditions, meetings or shoots, or agreeing to any engagement. FILMD is not responsible for the conduct of users on or off the platform, and you agree to take reasonable steps to protect yourself and your property.
Indemnity:You agree to indemnify and hold harmless FILMD from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with your Job postings, applications, communications, hiring decisions, engagements, or any breach of these Terms.
Limitation of Liability:Your use of this feature is subject to the Disclaimers and Limitation of Liability section of these Terms.
FILMD may allow users to communicate directly with one another through private or direct messaging features ("Direct Messages"). These features are provided to facilitate communication between users in connection with the Service.
User Responsibility:You are solely responsible for the content of any Direct Messages you send or receive and for your interactions with other users. FILMD does not endorse, verify or guarantee the accuracy, legitimacy or intent of any messages sent between users.
No Monitoring or Confidentiality:Direct Messages are private between users but are not confidential communications. FILMD does not guarantee the confidentiality, security or delivery of Direct Messages and does not routinely monitor or review message content. You should not send sensitive, confidential or legally privileged information through Direct Messages.
Prohibited Conduct:You agree not to use Direct Messages to send content that is unlawful, abusive, threatening, harassing, discriminatory, sexually explicit, deceptive or otherwise objectionable, or to engage in spam, scams, fraudulent activity, unsolicited promotions or impersonation. You also agree not to use Direct Messages to solicit payment, personal data or sensitive information in a misleading or unsafe manner.
Safety and Due Diligence:You are responsible for exercising appropriate caution and judgement when communicating with other users, including when sharing personal information, arranging meetings, auditions, shoots or work engagements. FILMD is not responsible for the conduct of users on or off the platform and does not guarantee the identity, intent or behaviour of any user.
Reporting and Moderation:FILMD may provide tools that allow users to report Direct Messages that they believe violate these Terms or applicable law. FILMD reserves the right, but is not obligated, to review, restrict, suspend or disable Direct Messaging access, or take other appropriate action, with or without notice, where we reasonably believe misuse has occurred.
Access and Availability:FILMD does not guarantee the availability, delivery or retention of Direct Messages and may impose limits, restrictions or technical controls on messaging features at any time. Messages may be deleted, delayed or unavailable due to moderation, technical issues or changes to the Service.
Limitation of Liability:Your use of this feature is subject to the Disclaimers and Limitation of Liability section of these Terms.
FILMD may provide a Members Map feature that allows users to discover other members based on approximate location and other profile information. Inclusion in the Members Map is subject to your account privacy settings and is designed to facilitate professional discovery and networking while prioritising user privacy and safety.
Approximate Location Display:Locations displayed on the Members Map are approximate only and do not represent a user’s precise or real-time location. FILMD deliberately obscures exact location data and displays map pins within a general radius of a user’s location in order to prevent identification of a user’s exact address or whereabouts. The method and radius used to display approximate locations may vary and may change over time.
User Control and Opt-Out:Participation in the Members Map is optional. You may choose to appear on the Members Map, or opt out entirely through your account privacy settings. If you opt out, your profile will not be displayed on the Members Map. You are responsible for keeping your location and privacy preferences up to date.
No Real-Time Tracking:FILMD does not provide real-time tracking of users and does not continuously update or broadcast a user’s live location. Location information shown on the Members Map is derived from user-provided data and is intended solely to indicate general proximity, not exact positioning.
Accuracy and Reliance:FILMD does not guarantee that location information displayed on the Members Map is accurate, current or complete. You agree not to rely on the Members Map as a precise indicator of another user’s location or availability.
Privacy and Acceptable Use:The Members Map is provided for professional discovery purposes only. You agree not to use the Members Map or any location information displayed through the Service to attempt to determine another user’s precise location, address, movements or personal circumstances, or to engage in harassment, surveillance or any other unsafe or inappropriate behaviour.
Limitation of Liability:Your use of this feature is subject to the Disclaimers and Limitation of Liability section of these Terms.
FILMD may allow users to create and manage private or restricted project workspaces ("Productions") to organise film, television or audiovisual projects. Productions may include features such as team management, internal discussions, file storage, scripts, messages, and other tools provided by FILMD from time to time.
User-Controlled Workspaces:Productions are created and controlled by users. FILMD does not manage, supervise, direct or participate in any Production and does not act as a producer, co-producer, employer, agent, manager or representative of any user or project. All decisions relating to a Production, including access, roles, content and communications, are the responsibility of the users involved.
Access and Privacy:Productions may be private or restricted to users invited or authorised by the Production owner or administrators. You are responsible for managing access permissions and ensuring that only intended participants are granted access. FILMD does not guarantee that Production content will remain confidential and is not responsible for unauthorised access resulting from user actions, configuration choices or sharing of access credentials.
Production Content and Files:Any content uploaded, created or shared within a Production, including scripts, files, messages, documents and other materials ("Production Content"), is user-generated content. FILMD does not claim ownership of Production Content and does not verify its accuracy, legality or completeness. Users are responsible for ensuring they have the rights to upload and share Production Content with others.
No Confidential Submissions:Productions are not confidential submission systems. Do not upload or share confidential, sensitive or legally privileged information unless you are comfortable doing so. FILMD does not accept Production Content in confidence and does not assume any duty of confidentiality in relation to Production Content.
Collaboration and Conduct:Interactions within Productions are solely between users. FILMD is not responsible for disputes, disagreements, miscommunication or conduct occurring within or arising from the use of Productions. You are responsible for complying with applicable laws, contractual obligations and professional standards when collaborating with others.
Tasks, Scheduling and Production Tools:FILMD may provide tools for managing tasks, schedules, call sheets, announcements or other production-related information. These tools are provided for organisational purposes only. FILMD does not guarantee the accuracy, completeness or delivery of any task, schedule, call sheet or instruction and is not responsible for missed deadlines, errors, delays or production outcomes.
Availability, Data Loss and Backups:FILMD does not guarantee the availability, integrity or preservation of Production Content. While we may perform regular backups, content may be lost, corrupted or deleted due to technical issues, moderation, user actions or changes to the Service. You are responsible for maintaining independent copies of any Production Content you consider important.
Moderation and Removal:FILMD reserves the right, but is not obligated, to review, restrict, suspend or remove Production Content or access to Productions at any time, with or without notice, where we reasonably believe such content or use violates these Terms, applicable law, or poses a risk to users, productions or the platform.
Limitation of Liability:Your use of this feature is subject to the Disclaimers and Limitation of Liability section of these Terms.
FILMD may offer an accreditation scheme ("Accreditation") intended to recognise certain professional experience, competence or standing within defined filmmaking professions or job roles. Accreditation is an additional, optional status and is distinct from general profile information, verification badges or FILMD membership.
Discretion and Assessment:The granting, refusal, renewal or withdrawal of Accreditation is at the sole discretion of FILMD. Accreditation decisions are based on information provided by the applicant, any supporting materials, and FILMD’s published or unpublished accreditation criteria at the time of assessment. FILMD is not obliged to grant Accreditation to any applicant and does not guarantee approval.
Role-Specific Accreditation:Accreditation is awarded in respect of a specific profession or job role only. FILMD defines the eligible professions and job roles for Accreditation and may amend or withdraw eligibility criteria over time. Accredited status does not extend beyond the specific role for which it is granted.
Accuracy of Information and Enquiries:By applying for Accreditation, you confirm that all information provided is accurate, complete and not misleading. You authorise FILMD to make reasonable enquiries, including contacting named referees, collaborators or industry professionals, to assess the validity of claims made in your application or during the accreditation process.
No Guarantee or Endorsement:Accreditation does not constitute an endorsement, guarantee of competence, guarantee of conduct, guarantee of safety, guarantee of employment, or guarantee of future work. Accreditation reflects an assessment at a point in time based on information available and does not replace independent judgement, due diligence or professional oversight by others.
Third-Party Process Recognition:FILMD’s accreditation processes and procedures may be reviewed or recognised by third-party organisations, such as industry bodies. Any such recognition relates solely to FILMD’s process and procedures and does not constitute verification, endorsement or approval of any individual accredited member by that third party.
Additional or Secondary Accreditation:FILMD may introduce additional accreditation requirements, supplementary checks or secondary accreditations for certain roles, skills or responsibilities. Such requirements may vary by role and may change over time. FILMD will communicate applicable requirements where relevant.
Membership Status:Accreditation is independent of FILMD membership tiers. Holding a FILMD membership does not guarantee Accreditation approval. Where Accreditation is tied to a specific membership level, accredited status may be suspended or withdrawn if membership is downgraded, cancelled or lapses due to non-payment.
Changes, Suspension and Removal:FILMD reserves the right to suspend or withdraw Accreditation at any time, with or without notice, including where information becomes inaccurate, standards are no longer met, misuse is identified, or these Terms are breached. FILMD is not required to provide reasons or an appeals process.
Editing Profession or Role:Once Accreditation is granted for a specific profession or job role, you may not change that role while retaining accredited status. Requests for role changes or clarifications may be reviewed by FILMD on a discretionary, case-by-case basis.
Representations and Final Decision:FILMD may, at its discretion, consider representations regarding Accreditation decisions. Any review of such representations does not create a right of appeal, and any decision made following review is final.
Misuse and Solicitation:Users must not misrepresent, misuse or attempt to improperly influence the Accreditation process, including by soliciting or pressuring other users to support accreditation applications without a genuine professional basis. FILMD reserves the right to take enforcement action where misuse is identified.
FILMD Chats live sessions are exclusively for FILMD members. FILMD Connect members have access to the recordings post-event but do not have live access.
Reservation and Attendance for Members:Spots for live FILMD Chats are reserved for FILMD members and are available on a first-come, first-serve basis. FILMD Members must reserve their spot via the FILMD platform and ensure timely attendance.
Recorded Content Access:Recorded versions of FILMD Chats are accessible to both FILMD Membership and FILMD accounts. The availability period for each session's recording may vary.
Question Submission:FILMD members are encouraged to submit questions in advance for the FILMD Chats. Live question opportunities during the session are at the discretion of the hosts and subject to time constraints.
Content Usage:The content of FILMD Chats, including recorded sessions, is for personal use only. Redistribution, reproduction, or commercial use is strictly prohibited without prior written consent from FILMD.
Member Conduct:Members are expected to maintain professional decorum during FILMD Chats. FILMD reserves the right to revoke access to the chats for any member found violating this expectation.
Cancellation Policy:FILMD reserves the right to cancel or reschedule FILMD Chats sessions. Members will be notified in advance in such cases.
Feedback and Suggestions:FILMD values member feedback for FILMD Chats and encourages suggestions for future topics or improvements.
Changes to Terms & Conditions:FILMD reserves the right to modify these T&Cs at any time. Continued participation in FILMD Chats after such changes constitutes acceptance of the new terms.
Dispute Resolution:Any disputes related to FILMD Chats shall be addressed directly with FILMD’s support team. Decisions made by FILMD regarding disputes are final.
FILMD may from time to time offer grants, funding initiatives or similar support programmes ("FILMD Grants") to support filmmaking projects. FILMD Grants are discretionary, competitive initiatives and are not guaranteed to be offered, awarded, continued or repeated.
No Obligation or Guarantee:Submission of an application does not guarantee shortlisting, selection, funding, feedback or award. FILMD is under no obligation to award any grant, to award a grant to any particular applicant, or to provide reasons or feedback for decisions made in connection with FILMD Grants.
Eligibility and Conditions:Eligibility criteria for FILMD Grants may vary by programme and may include requirements relating to script length, genre, production location, country of residence, experience level, or other factors. FILMD reserves the right to determine eligibility criteria and to amend, suspend or withdraw such criteria at any time.
Copyright and Ownership:You retain full copyright and ownership of any script, film or other materials submitted in connection with a FILMD Grant. Nothing in these Terms transfers ownership of intellectual property rights to FILMD.
Access and Use of Submissions:By submitting materials for a FILMD Grant, you grant FILMD a non-exclusive, royalty-free licence to access, read, view, share and internally evaluate such materials solely for the purposes of administering, assessing and promoting the FILMD Grants programme. FILMD does not treat submissions as confidential.
No Partnership or Production Relationship:Award of a FILMD Grant does not create a partnership, joint venture, employment, agency, producer, co-producer, investor or commissioning relationship between FILMD and any applicant or recipient. FILMD does not assume any responsibility for the development, production, financing, completion or exploitation of any project.
Grant Recipient Conditions:As a condition of receiving a FILMD Grant, recipients may be required to comply with additional programme terms, including maintaining an active FILMD membership, posting cast and crew opportunities on the FILMD platform, and making reasonable efforts to engage with the FILMD community in connection with the funded project.
Publicity and Promotion:By applying for or accepting a FILMD Grant, you grant FILMD the right to publicly reference your participation in the programme, including sharing information about you, the project and the grant award across FILMD-owned channels, press materials and marketing communications, including links to your FILMD profile and publicly available social media profiles.
Screening Room Inclusion:Grant recipients may be required to allow the completed film to be featured in the FILMD Screening Room, subject to the Screening Room terms and any applicable visibility or timing conditions. Inclusion in the Screening Room does not guarantee prominence, promotion or audience reach.
Acknowledgement of Support:Any publicly exhibited or distributed work produced with the support of a FILMD Grant must include a reasonable acknowledgement of FILMD’s support, which may include a title card and credit placement, in a form specified by FILMD from time to time.
Changes, Withdrawal and Cancellation:FILMD reserves the right to amend, suspend, withdraw or cancel any FILMD Grant programme at any time, including after applications have been submitted or grants have been announced, where required by operational, financial or legal considerations.
Limitation of Liability:To the fullest extent permitted by law, FILMD shall not be liable for any loss, cost, damage or harm arising out of or in connection with FILMD Grants, including reliance on grant availability, selection decisions, funding outcomes, production delays, project failure or cancellation.
FILMD may send users notifications and communications in connection with the Service, including notifications relating to activity, messages, comments, replies, recommendations, follows, jobs, applications, productions, updates or other events ("Notifications"). Notifications may be delivered via in-app alerts, email, push notifications or other communication channels.
Informational Nature:Notifications are provided for informational and convenience purposes only. FILMD does not guarantee the accuracy, completeness, timeliness or delivery of any Notification, and Notifications should not be relied upon as the sole means of receiving or acting on important information.
No Guarantee of Delivery:FILMD does not guarantee that Notifications will be delivered, received, displayed or acted upon, or that they will be delivered in real time. Notifications may be delayed, suppressed, duplicated or unavailable due to technical issues, user settings, third-party service providers, network conditions or changes to the Service.
User Control and Preferences:You may be able to manage your Notification preferences, including opting in or out of certain Notifications, through your account settings or device settings. You are responsible for maintaining accurate contact details and Notification preferences. Certain service-related communications may still be sent where required to operate the Service or comply with legal obligations.
Third-Party Delivery Services:FILMD may rely on third-party services to deliver Notifications, including email and push notification providers. FILMD is not responsible for failures, delays or errors in Notification delivery caused by third-party services or user device settings.
No Reliance or Liability:You agree not to rely on Notifications for time-sensitive, safety-critical or contractual matters. FILMD shall not be responsible for any loss, damage or missed opportunity arising from reliance on Notifications or failure to receive or act on any Notification.
Changes and Availability:FILMD may modify, suspend or discontinue any Notification feature or communication channel at any time, with or without notice. FILMD does not guarantee the continued availability of any specific Notification type or delivery method.
FILMD respects the copyright and intellectual property rights of others and expects users of the Service to do the same. Users must not upload, post, submit, share or otherwise make available any content that infringes the copyright or other intellectual property rights of any third party.
Reporting Alleged Infringement:If you believe that content available on the Service infringes your copyright or other intellectual property rights, you may submit a written notice of alleged infringement for review by FILMD.
Information Required in a Notice:To allow us to review a claim, notices should include sufficient information to identify the material and assess the allegation, including:
Your name and contact details (email address and, where available, a telephone number and postal address).
A description of the copyrighted work or intellectual property you claim has been infringed.
The specific URL(s) or location(s) within the Service where the allegedly infringing material appears.
An explanation of why you believe the material infringes your rights.
A statement that you have a good faith belief that the use of the material is not authorised by the rights holder, its agent or the law, and that the information provided is accurate.

Review and Action:FILMD will review infringement notices in good faith and may, at its discretion, take appropriate action. Such action may include requesting additional information, removing or disabling access to the material, or contacting the reporting party and/or the user who posted the material. FILMD does not guarantee a particular outcome or timeframe for any review.
Repeat or Serious Infringement:FILMD reserves the right to suspend or terminate accounts that repeatedly or seriously infringe the intellectual property rights of others.
Misuse of the Reporting Process:You must not submit false, misleading or abusive infringement notices. FILMD reserves the right to reject notices that lack sufficient information or appear unfounded, and may take appropriate action where misuse of this process is identified.
The Service, including the FILMD platform, websites, web and mobile applications, software, databases, designs, user interfaces, text, graphics, logos, icons, features, functionality and all related intellectual property rights, are and will remain the exclusive property of FILMD and its licensors. The Service is protected by copyright, trademark and other laws of the United Kingdom and other jurisdictions.
Restrictions on Use:Except as expressly permitted by FILMD in writing, you must not copy, reproduce, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, scrape, extract data from, or otherwise exploit any part of the Service or its underlying software, systems or content.
Trademarks and Branding:FILMD names, logos, trademarks, service marks and trade dress may not be used in connection with any product, service or promotion without the prior written consent of FILMD.
User Content and Platform IP:Except for User Content submitted by users (which remains owned by the respective users as set out elsewhere in these Terms), nothing in these Terms grants you any rights in or to FILMD’s intellectual property or the Service itself.
Feedback and Suggestions:We welcome feedback, suggestions and ideas relating to the Service. By submitting feedback to FILMD, you agree that FILMD may use such feedback without restriction or compensation. To the extent permitted by law, you assign all rights, title and interest in such feedback to FILMD. Where such assignment is ineffective for any reason, you grant FILMD a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, modify, distribute and otherwise exploit the feedback for any purpose.
No Waiver of Rights:Nothing in these Terms limits FILMD’s right to independently develop, acquire, license or market products, services or features that may be similar or competitive to ideas or feedback provided by users.

We have no control over the content, privacy policies, or practices of these third-party websites or services. You acknowledge and agree that the Company is not responsible for any damages or losses caused by or in connection with the use of such content, goods, or services available on or through these third-party websites or services.

The Service may be unavailable, degraded or disrupted due to maintenance, updates, technical issues, third-party failures, network conditions or other factors beyond FILMD’s control.
Changes to the Service:FILMD may add, remove, modify or replace features, functionality, content or interfaces of the Service at any time. FILMD does not guarantee the continued availability of any specific feature, tool, workflow or capability, and users should not rely on the Service for any particular functionality or outcome.
No Reliance for Critical Use:The Service is not intended to be relied upon as the sole system for time-critical, safety-critical, legal, financial or production-critical activities. You are responsible for maintaining appropriate alternative processes, backups and records where necessary.

FILMD may from time to time make available certain features, tools or functionality that are identified as beta, experimental, early access or similar ("Beta Features"). Beta Features may be offered to some or all users and may be subject to additional conditions or limitations.
No Guarantee or Warranty:Beta Features are provided on an “as is” and “as available” basis and may contain errors, bugs or incomplete functionality. FILMD does not guarantee the reliability, availability, accuracy or performance of any Beta Feature and does not warrant that Beta Features will be made generally available.
Changes and Removal:FILMD may modify, suspend or remove Beta Features at any time, with or without notice. FILMD does not guarantee continuity of access, data preservation, feature behaviour or compatibility with other parts of the Service.
No Reliance:You agree not to rely on Beta Features for production-critical, time-sensitive, safety-critical, legal or financial activities. Any use of Beta Features is at your own risk.

FILMD reserves the right, at its sole discretion, to suspend, restrict or terminate your account, or access to all or part of the Service, at any time, with or without notice, where we reasonably believe that you have breached these Terms, violated applicable law, misused the Service, posed a risk to other users, or where such action is necessary to protect FILMD, users, third parties or the integrity of the platform.
Effect of Suspension or Termination:Upon suspension or termination of your account, your right to access and use the Service will immediately cease. FILMD may restrict access to, remove or disable User Content, Productions, messages, files or other materials associated with your account. FILMD does not guarantee continued access to any content following suspension or termination.
No Obligation to Provide Reasons or Notice:FILMD is not obligated to provide advance notice of suspension or termination, nor to provide reasons, warnings or an opportunity to remedy any breach, except where required by law.
Outstanding Obligations:Suspension or termination of your account does not relieve you of any obligations accrued prior to termination, including payment obligations, intellectual property licences granted to FILMD, or compliance with applicable laws and contractual commitments to other users.
Reinstatement:Any reinstatement of a suspended or terminated account is at the sole discretion of FILMD and does not create any right or expectation of continued access to the Service.
Survival:Provisions of these Terms which by their nature should survive termination, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnities and governing law, shall survive termination of your account.
These Terms and any dispute or claim arising out of or in connection with the Service or these Terms (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

FILMD shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from events beyond FILMD’s reasonable control ("Force Majeure Events").
Force Majeure Events:Force Majeure Events may include, without limitation, acts of God, natural disasters, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, strikes or labour disputes, failure of utilities or telecommunications, power outages, internet or network failures, government action, changes in law, or failures of third-party service providers, hosting providers or infrastructure.
Effect of a Force Majeure Event:During a Force Majeure Event, FILMD’s obligations under these Terms shall be suspended to the extent affected by the event, and FILMD shall use reasonable efforts to resume performance as soon as practicable once the Force Majeure Event has ceased.
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, FILMD disclaims all warranties, representations and conditions, whether express, implied or statutory, including implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, availability, accuracy and reliability.
Limitation of Liability:To the fullest extent permitted by law, FILMD shall not be liable for any loss or damage arising out of or in connection with your use of or inability to use the Service, including loss of profits, loss of income, loss of business, loss of opportunity, loss of data, loss of goodwill, production delays, missed opportunities, or any indirect, incidental or consequential loss.
User Interactions:FILMD is not responsible for the conduct of users or third parties, whether online or offline. Any interactions, engagements, collaborations, transactions or disputes between users are solely between the users involved, and FILMD shall not be liable for any resulting loss, harm or damage.
Maximum Liability:Where liability cannot be excluded, FILMD’s total aggregate liability to you for any claims arising out of or in connection with the Service or these Terms shall be limited to the greater of (a) the total amount paid by you to FILMD in the twelve months preceding the claim, or (b) £100.
Non-Excludable Liability:Nothing in these Terms excludes or limits FILMD’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity or enforceability of the remaining provisions.
Waiver:No failure or delay by FILMD in exercising any right, power or remedy under these Terms shall operate as a waiver of that or any other right, power or remedy. Any waiver must be made expressly and in writing by FILMD.
Translation:These Terms may be translated for convenience only. In the event of any conflict or inconsistency between a translated version and the English-language version, the English-language version shall prevail.
Changes to These Terms:FILMD may update or amend these Terms from time to time. Where required by law or where changes are material, FILMD will take reasonable steps to notify users in advance. Continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

FILMD Services Ltd is authorised under licence to use such intellectual property to operate the FILMD platform, provide the Service, and enter into contracts with users. References to "FILMD", "we", "us" or "our" in these Terms include FILMD Ltd and FILMD Services Ltd, as applicable.
